US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

Legal scene

A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.

The case originates in a erroneous removal to El Salvador in March, which the government later admitted was an error. Following his return to the United States to face human smuggling allegations, he was held in immigration custody.

In her order, the judge pointed out that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Background of the Legal Challenge

The legal challenge center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.

Conditions of Freedom

The court, who was overseeing his challenge to deportation in a federal court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order shifts his monitoring to the Tennessee court.

This ruling represents a notable turn in a complicated legal battle featuring claims of wrongful detention and disputed criminal affiliations.
